Return/Refund Policy

This Return / Refund policy applies only to www.hubcapcomedyfestival.ca HubCap Comedy Festival de l’humour Inc.(herein after referred to as HCF) the operator of this website and www.hubcappromotions.ca and HubCap Promotions, a division of HubCap Comedy Festival, (herein after referred to as HCP). HCF / HCP along with its officers, directors, employees, clients, contractors and subcontractors are required to honour this Return/Refund Policy Statement.

Returns, Exchanges or Cancellations

We trust you will be happy with your purchase; however, we do understand that there may be occasions when you wish to discuss your purchase. If you are unhappy with a purchase for any reason please contact us immediately at 1 (888) 855-8522 or via email at info@hubcapcomedyfestival.ca with the details.

For each purchase you will have the opportunity to review our return, refund and cancellation policies in detail prior to completing your payment.

Event Tickets:

There will be no refunds available for event show tickets purchased unless the event show is cancelled by the producer. Exchanges of tickets are at the discretion of the producer, based on availability and timeliness of advance request.

Registration:

There will be no refunds or exchanges available for event registration fees unless the event is cancelled by the producer.

Merchandise:

We trust you will be happy with your purchase; however, we do understand that there may be occasions when you wish to return an item. If you are unhappy with a product, then please contact us immediately at 1 (888) 855-8522 with the details of your request.

We will only arrange to exchange or refund of goods once they are returned in perfect condition, unused and with their original packaging. We will require you to pay for the return postage of any items being returned and, for your own protection we recommend you use a secure delivery method which requires a signature upon delivery.

Damaged Items:

Your items are shipped with insurance, so if the goods arrive damaged please advise us immediately by email or telephone for instructions on arranging a return, refund or replacement of the items.

Refunds for the return of damaged goods and reimbursement of the cost of postage will be made to the credit/debit card account used to purchase the items.

Some Terms We Use in this Policy

Personal Information is any information that identifies you with the exception of professional information such as your business address, business telephone and facsimile numbers and business e-mail address. It also includes your credit card number.

If you choose to purchase products and/or services from us or one of our client’s sites, you must provide the following information: your name, credit card information, telephone number (in case our customer service personnel need to reach you about your order), mailing and/or shipping address, email address (so that we may send an email message about your order and, if you opted-in, to send you our email newsletter and/or special offers). In the following paragraphs, we outline the services and activities in connection with which we gather your Personal Information and provide details on how that Personal Information is used.

All of these services are optional; if you do not wish to provide Personal Information, you may simply decline to take advantage of that service.

Personal Information is collected in the following ways:

Online Purchases – To process your order, to contact you regarding your order, or to answer any questions/concerns you might have expressed.
Online Registration – You do not have to register online with us or our clients. Upon request a hard-copy form can be sent to you instead, but most online functions will not be available to you. As a registered member of our client’s site, you give us permission to store Personal Information about you, such as your e-mail address, online. This information is “remembered” each time you login and allows us to customize your site experience to your interests and to speed up the shopping process. Note: we do not store credit card information, which must be entered each time you place an order or register.

You may be contacted about contests, sweepstakes and other special offers if you have opted to receive them. In all cases, we will disclose the information consistent with applicable laws and regulations and we will require the recipient to protect the information and use it only for the purpose it was provided.

HCF / HCP is obligated to share your Personal Information with the Contractors who we use for processing your business, as necessary to complete a transaction that you specifically request.

Under certain agreements we may make segments of your Personal Information available to other organizations as noted below:

Contractors

Under certain agreements, we may transfer aggregate survey information or information about your order, including your name, mailing address, description of your purchase and its dollar amount to a third party that we have retained to assist us in analyzing our marketing efforts to you. The third-party marketing company may use this information to assist in making decisions about the dissemination of our survey information or marketing and promotional offers. These companies are contractually prohibited from using, in any manner, the information obtained in the course of providing these services to HCF / HCP.
Our Web Master, a third-party service provider, is used to help us gather and analyze our customers’ activities on our site. Their only role is to help us deliver the most relevant products and services to you. The information we share with them is anonymous, meaning that none of your identifiable Personal Information (such as your name, home address, credit card number, etc.) will be received by or shared with them. The only exception to the sharing of anonymous information is in the sharing of our opt-in email address list. In this instance they are helping us improve our client’s email offers to you by analyzing your requests. Our Web Master is contractually prohibited from using, in any manner the information obtained in the course of providing these services to HCF / HCP other than to help us provide you the best possible shopping experience on our site. HCF / HCP respects your right to choose whether to be included in the services provides to us by the third party. If you have opted in to receive email from us we will share your name and email address with our email service provider that delivers our email newsletters and special offers, but its use of this information is only permitted in connection with their administration and delivery of our email program.

How We Strive to Protect Personal Information

Through HCF and HCP we have electronic and corporate policies and procedures in place for the security of every order placed online. We use Secure Socket Layer technology (SSL) to keep others from intercepting your information while it is being transmitted across the Internet. E-Mail Abuse

There are many unscrupulous individuals operating on the internet today who would think nothing of fabricating an email to make it appear that it comes from HCF or HCP. These individuals may be engaging in a practice known as “phishing” in which they attempt to trick unwary recipients of email into divulging Personal Information. HCF / HCP will never request Personal Information in an unsolicited email message to you.

If you have any question about the genuineness of an email you receive that appears to be from HCF or HCP contact us at abuse@hubcapcomedyfestival.ca and do not furnish Personal Information in response to the email unless its authenticity can be verified.

Transaction Security

Secured communications on the web require attention to authentication, encryption and data integrity. All three are addressed by the Secure Socket Layer (SSL) protocol. Terms and Conditions

This Terms And Conditions Policy Statement applies only to www.hubcapcomedyfestival.ca HubCap Comedy Festival de l’humour Inc.(herein after referred to as HCF) the operator of this website and www.hubcappromotions.ca and HubCap Promotions, a division of HubCap Comedy Festival, (herein after referred to as HCP). Ownership

The person whose name is indicated on the sales agreement shall be deemed to be the Holder. HCF and HCP will deal only with the Holder in all matters pertaining to the tickets or other items purchased under the sales agreement. Should a Holder wish to have someone else named to handle such matters, written authorization must be submitted by the Holder to HCF / HCP for approval.

Description and Availability of Goods and Services

Every effort has been taken to ensure that the descriptions, photographs and specifications of the products and services provided by HCF / HCP and our clients are correct.

Services:

The description of services provided covers the basic offerings. Customized service offerings will be laid out in addendums.

Through our inventory tracking systems, you will not be able to purchase an item that is not available. In the event that we are unable to supply any items, we will inform you of this as soon as possible.

Goods:

The colour of the goods or packaging may vary slightly from that shown on the website due to the limitations of some browsers and monitors. Sometimes props are used in demo photographs, in such cases the product description indicates which item is being advertised for purchase.

Some of our items for sale may be hand-made and as such there may be slight variations in these particular items.

Through our inventory tracking systems, you will not be able to purchase an item that is not available. In the unlikely event that we are unable to supply any items, we will inform you of this as soon as possible.

Purchasing and Ordering

If you have supplied us with a functional email address, we will notify you by email immediately to confirm receipt of your purchase or order. If you do not see the purchase confirmation email within a few minutes of your purchase, be sure to check your spam email folder and mark the email as safe. If you do not see the purchase confirmation email in any folder, contact us at info@hubcapcomedyfestival.ca or 1-888-855-8522. If the provided email address is not functional a hard copy may be sent out to the mailing address provided.

Pricing and Applicable Taxes

All prices quoted are in Canadian Dollars and, where applicable, are subject to provincial and federal taxes. When taxes are applicable the GST/HST number will be provided upon request.

HCF / HCP in not liable for any errors in Prices quoted. The customer will have the opportunity to see the final total price prior to confirming the payment and may decide to quit or proceed with the purchase process at that time.

Prices do not include service or delivery fees. The total cost of your order is the price of the products ordered plus the indicated additional charges.

Delivery

Any applicable delivery charges are clearly indicated on the checkout page with your purchase total breakdown.

Orders are normally dispatched within two working days of receipt of the order; however, please allow up to five working days for delivery.

When available, request for express or next-day delivery will result in additional delivery charges.

If you have purchased tickets for an event less than two weeks away, we will contact you with details regarding last minute delivery or pick up options, or feel free to contact us directly to make arrangements.

In the event a particular item is out of stock we will advise you accordingly and provide you with an estimated delivery date, refund options or alternate/replacement options.

Please ensure that we are given full and correct contact information as directed.

For delivery outside of Canada please contact us for a quotation for delivery and handling charges. Some foreign orders may be subject to local import duties and we will not be liable for these payments.

Payment

You can pay for your order using most major credit cards through our payment page.

Payment is to be made online at the time of order. All credit/debit card holders are subject to validation checks and authorisation. If the issuer of your payment card refuses to transfer payment to us, we will not be liable for any delay or non-delivery.

Complaints

If you have any complaints with our services or products, please contact us as soon as possible. We will make every effort to rectify the situation for you.

Governing Law

These Terms shall be governed by the law of the Province of New Brunswick, without regard to its conflict of law’s provisions. Any action or proceeding arising out of or relating to these Terms must be brought in the courts of the Province of New Brunswick. The Holder knowingly, voluntarily, and irrevocably submits to the exclusive jurisdiction of the courts located in Moncton, New Brunswick in any such action or proceeding and waives any objection it may now or hereafter have to venue or to convenience of forum.
